Attorney Le Quang Vinh invited to present comment and critique on the Draft Amendments 5.0 to the IP Law before the National Assembly's Legal Committee

Senior Partner Le Quang Vinh was invited to present his comments and critiques on the Draft Amendments 5.0 to the IP Law (Draft Law 5.0) that is first reviewed by the National Assembly's Legal Committee at the webinar took place on the morning of August 28, 2021, moderated by Mr. Hoang Thanh Tung - Member of the Central Committee of Communist Party - Director of the National Assembly's Legal Committee.
The online conference had participation of congressmen coming from Committee on Justice, Committee on Science, Technology and Environment, Committee on Economy, Committee on Finance and Budget, Committee on Foreign Affairs, Committee on Culture and Education as well as the presence of the representatives of the Government Office, Ministry of Science and Technology, Ministry of Justice, Ministry of Foreign Affairs, Ministry of Finance, Ministry of Culture, Sports and Tourism, and Ministry of Agriculture and Rural Development, and VCCI and VIPRI.

Attorney Vinh’s comment and critique quoted by the National Assembly Portal (Cổng thông tin điện tử Quốc Hội Việt Nam) saying that “the Draft Law 5.0 is the largest law revision project to the IP Law because there are 94 articles out of 222 articles covering most IP subject matters that was proposed by the Government and submitted to the National Assembly’s ratification in compliance with international commitments in a series of free trade agreements (FTAs) recently joined by Vietnam. Vinh also said that the Intellectual Property Law recognizes and protects many different types of exclusive rights for different periods of time on the basis of different protection conditions. Therefore, the principle of balancing the interests between intellectual property rights and other constitutional rights of citizens and organizations such as the right to competition freedom, the right to public access information, the right to education, etc. must be guaranteed in practice”.
